The present selling conditions are only applicable to the end-users on-line sales of MYFASHIONMALL.COM. They will be applied with exclusion of any other condition, even those mentioned on the orders formulated by the buyer. MYFASHIONMALL.COM reserves them the right to modify at any time the general conditions. Nevertheless, running contracts are threatened at the conditions of the moment the sales was closed.
There, where it is indicated, the conditions are only applicable to the sales to a "consumer"; which is a natural or a legal person who is only buying products on the site for purposes which are not professional ones.
3. CONCLUSION OF ON-LINE SALES
The product catalogue and the description on the site of MYFASHIONMALL.COM do not constitute a quote as such This means it is not enough to fill out a reservation formulary on our site as a sales agreement. A sale is concluded definitively only after reception of an acknowledgement per e-mail. For the security and the safety of the customers, MYFASHIONMALL.COM reserve them the right to ask for more information and to refuse the execution of the order by lack of a appropriate answer.
MYFASHIONMALL.COM can also refuse an order when it appears the buyer has the intention to re-sell the products.
The agreement can be concluded in French, Dutch or in English, in accordance to the customer’s wish. The later exchange of information will be done as well in these languages. The customer will not be able to appeal to his lack of knowledge of the chosen language, in order to make apply or not apply one or more conditions.
4. TRANSFER OF PROPERTY
In contravention to the article 1583 of the (Belgian) Civil code, the goods that are sold, delivered or installed stay exclusively property of MYFASHIONMALL.COM till integral payment of the invoices. Despite this reservation of property, all risks of loss and damage relative to the concerned goods are transferred to the customer as from taken into possession.
5. PRICE
Our prices are inclusive VAT. Normal delivery and expedition costs are indicated, taking into consideration the information about place of delivery given by the customer. Offers are valid all the time of being on-line. Indicated prices may change. In case of an order, the valid price is the one valid on the moment the on-line order was placed.
6. PAYMENT
The customer is paying directly by credit cart (via highly secured way). MyFashionMall.com charges the creditcard the day the order is shipped.
Payments can also be done via bank transfer to MyFashionMall indicating your order Nº as reference, please.

7. DELIVERY
Normally, the good are delivered by courier. Delivery costs are on charge of the customer, and clearly indicated during the process of the order. MYFASHIONMALL.COM can at any time modify the way of and prices of transportation just by putting a notice about it on the site.
The average delivery time can be 7 to 10 days. Delivery terms are fairly estimated and are just indicative and therefore do not form an essential condition of the sales. Please note that order paid by banktransfer will only be shipped once the bank transfer has been made and arrived. To be taken into consideration, any complaint about visible damage of the packaging of delivered goods must be mentioned on the delivery documents. Any complaint about damage or defect of the goods themselves must be formulated per e-mail to contact@myfashionmall.com within the 24h following delivery.
8. RIGHT OF RENONCIATION
According to the Belgian law of the 14th of July 1991, the consumer is entitled to notify to the seller that he renounces to his purchase without penalty and without giving any reason, within 7 working days from the day after the delivery of the product.
This period allows the customer to value the purchased product just as when it would be ‘on the shelve’. Used, damaged or incomplete goods will not been taken back.
The customer who wants to use this right must contact MYFASHIONMALL.COM within 7 working days per mail or per e-mail.
In addition, in this same delay, he has to re-pack the product intact and completely in its original package together with all the accessories, as well as the invoice or despatch note and send it on his costs and responsibility to MYFASHIONMALL.COM.
Within the 30 days after acceptation of the return, MYFASHIONMALL.COM will reimburse of the price paid, with deduction of the delivery costs.
9. PROOFS
Both parties accept electronic means of proof (e-mail, back-up, …).
10. APPLICABLE LAW AND DISPUTES
Any dispute is governed by Belgian law. Courts of Brussels (Belgium) are the only competent ones.
